BEFIT CODE OF CONDUCT:
By submitting this form you agree to be bound by the BeFit Code of Conduct.
MEMBERSHIP FEE DETAILS:
By providing a payment method (credit card) for your membership, you explicitly give BeFit the authority to charge your membership fee on a weekly basis according to the term of your subscription. Payments are normally processed on a Thursday. If you sign up before Thursday your first charge will be pro-rated.
There is a one-time account setup fee of $15. Total cost of the membership will include a payment processing fee of $2 on the weekly payments in addition to the above cost.
All costs include GST.
On each occasion that a scheduled payment is declined for any reason, we will continue to attempt to process the payment each day after. If payments continue to fail the members ability to book classes will be limited
COOLING OFF PERIOD:
There is a seven (7) day cooling off period that begins on the date this form is submitted during which time you may terminate your membership by delivering written notice to BeFit.
The following charges will apply:
(i) All membership fees charged by BeFit to date.
(ii) The setup fee of $15.
(ii) Any payment processing fees paid to date.
RENEWAL POLICY:
Flexi Membership: Your membership will continue until you cancel your membership with two weeks notice.
6 Month Membership: Your membership will automatically renew month-to-month at the end of the current term at the standard rate unless you cancel at least 14 days before the end of the term.
CANCELLATION POLICY:
Flexi Membership: You may cancel your membership at any time with two weeks notice after the first month of membership is complete.
6 Month memberships: If you wish to cancel within your minimum term you can do so by paying out your contract – number of months left by half of weekly membership cost.
To notify BeFit of cancellation, send an email to [email protected] which details your name, email we have on file for you, cancellation date request and reason for cancelling.
ACCOUNT SUSPENSIONS:
6 Month Memberships: You may pause your membership for up to a maximum of six weeks within a 12month period by providing written notice to BeFit no less than 5 business days prior. Suspensions must start in line with your normal payment collection date (Thursday) but can end on any day.
Should any payments, fees or other debts remain due but unpaid from any source, BeFit may suspend your use of the services until all fees and other debts are paid in full.
LIABILITY WAIVER AND INDEMNITY:
BeFit is in no way responsible for the safekeeping of my personal belongings while I attend class.
I understand that classes at BeFit may be physically strenuous and have inherent dangers and risks and I voluntarily participate in them with full knowledge that there is a risk of personal (physical and mental) injury, property loss or death.
By submitting this form I agree that I, my heirs, assigns or legal representatives hereby release BeFit and their owners, volunteers, directors, officers, employees, trainers and independent contractors from any claims of any kind whatsoever for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.
I also agree to hold harmless and indemnify BeFit and their owners, volunteers, directors, officers, employees, trainers and independent contractors from any liability for property damage or personal injury which a third party may suffer as a result of me participating in classes at BeFit.
This policy details how we collect and treat your personal information.
“Personal information” is information we hold which is identifiable as being about you specifically.
Website Visitors
Like most website operators, BeFit collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request.
The purpose in collecting non-personally indentifying information is to understand how BeFit’s visitors use its website.
From time to time, BeFit may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.
BeFit also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users and for users leaving comments on befittraining.com.au blogs/sites. BeFit only discloses logged in user and commenter IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below, except that commenter IP addresses and email addresses are visible and disclosed to the administrators of the blog/site where the comment was left.
BeFit may collect statistics about the behavior of visitors to its websites. BeFit may display this information publicly or provide it to others. However, BeFit does not disclose personally-identifying information other than as described below.
Cookies
A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns.
BeFit uses cookies to help BeFit identify and track visitors, their usage of BeFit website, and their website access preferences. BeFit visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using BeFit’s websites, with the drawback that certain features of BeFit’s websites may not function properly without the aid of cookies.
Gathering of Personally-Identifying Information
Certain visitors to BeFit’s websites and physical premises choose to interact with BeFit in ways that require BeFit to gather personally-identifying information. The amount and type of information that BeFit gathers depends on the nature of the interaction.
For example, we ask visitors who sign up to trial or purchase our services at befittraining.com.au or at our physical premises to provide details about themselves. Those who engage in transactions with BeFit are asked to provide additional information, including as necessary the personal and financial information required to process those transactions.
In each case, BeFit collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with BeFit.
BeFit does not disclose personally-identifying information other than as described below.
Visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities.
Protection of Certain Personally-Identifying Information
BeFit discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organisations that:
need to know that information in order to process it on BeFit’s behalf or to provide services available at BeFit’s websites and physical premises, and
that have agreed not to disclose it to others.
Some of those employees, contractors and affiliated organisations may be located outside of Australia; by using BeFit’s websites or services you consent to the transfer of such information to them.
BeFit will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors and affiliated organisations, as described above, BeFit discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when BeFit believes in good faith that disclosure is reasonably necessary to protect the property or rights of BeFit, third parties or the public at large.
If you are a registered user of a BeFit website or BeFit services and have supplied your email address and/or phone number BeFit may occasionally send you an email, call you or send you an SMS to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with BeFit and our products. If you send us a request (for example via email or via one of our feedback mechanisms), we reserve the right to publish the request in order to help us clarify or respond to your request or to help us support other users.
You may unsubscribe from the communications which are about new features, updates or general feedback by emailing [email protected] with a request to be removed from these communications.
BeFit takes all measures reasonably necessary to protect against the unauthorised access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.
You may request details of the personal information that we hold about you in accordance with the provisions of the Privacy Act 1988 (Cth). A nominal fee may be payable for the administrative preparation and provision of this information. If you would like a copy of the information which we hold about you or believe that any information we hold on you is inaccurate, out of date, incomplete, irrelevant or misleading, please email us at [email protected] to request or update us.
We reserve the right to refuse to provide you with information that we hold about you, in certain circumstances which are set out in the Privacy Act 1988 (Cth).
Business Transfers
If part or substantially all of BeFit’s asset are acquired or in the unlikely event that BeFit goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party to the extent permissible by law.
You acknowledge that such transfers may occur, and that any acquirer of BeFit may continue to use your personal information as set forth in this policy.
Ads
Ads appearing on any of our websites or social media sites may be delivered to users by advertising partners, who may set cookies. These cookies allow the ad server to recognise your computer each time they send you an online advertisement to compile information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by BeFit and does not cover the use of cookies by any advertisers.
Privacy Policy Changes
Although most changes are likely to be minor, BeFit may change its Privacy Policy from time to time, and in BeFit’s sole discretion. BeFit encourages visitors to frequently check this page for any changes to its Privacy Policy. If you have a BeFit membership or account for services or information through the BeFit site, you might also receive an alert informing you of these changes. Your continued use of BeFit’s sites or services after any change in this Privacy Policy will constitute your acceptance of such change.
